Ok, so I am learning more and more each day about AR-15's and the NFA. I am curious about making a AR-15 pistol lower with a short 9" upper and do NOT want to do any NFA item on this one.

As I understand it, the way to "make" an AR-15 pistol is to buy a bare lower with NO buffer tube, like this one: PSA Blemished Bullet-Pictogram Lower - Receivers - Firearms and obviously buy a pistol buffer for it.

Then when I receive it do I HAVE to tell the FFL that he must fill out my form 4473 as a pistol and not a rifle?

you need to have the FFL either list it as "pistol" or "receiver" So make sure do not list it as rifle!

On question 18 of the 4473 form your FFL needs to check the "other firearm" box. This is for frames, stripped recievers, etc. Then you build your pistol.
