This is the preliminary reading, I guess we're going to need a new legal thread tomorrow, so lets start piecing it together. Broken down by relevant category:

This is not legal advice.

Ammunition:
400.03(7) - Sales and transfers must be made in person at and by licensed dealers.
400.03(3)(A) - Background checks for sale using a to be established state system or NICS.
400.03(5) - Records destroyed within one year.
Ammunition purchases are not probable cause of a crime.

s.400.10
Must report loss or theft of ammunition within 24 hours to police or sheriff.
Failure to report a loss of ammunition is a Class A Misdemeanor. Changing this section also turned the penalty for failure to report a lost weapon from a $100 max fine to a Class A Misdemeanor.

Firearms:
Private sales/transfers are now illegal. A transfer of ownership must go through an FFL unless it is between immediate family members (spouses, domestic partners, children and step-children).

Failure to register a FIREARM lawfully possessed prior to the effective date which requires registration is a Class E Felony. (256.01-B).
(Wondering what this would apply to, seems like an additional penalty for failing to register a semi-auto pistol that was pre-94 ban or legal in features under the 2000 Ban provisions. Nothing else would be a firearm legal to possess and also subject to registration - need to think about this more.)



Assault Weapons:

Old guns would be registered:
Failure to register knowingly is a Class A Misdemeanor (the author fails to say exactly what, "such weapon" is but it appears to refer to pre-1994 ban and 2000 ban complaint guns).
Failure to register unknowingly results in a warning from Law Enforcement and 30 days to register the weapon. If not registered or surrendered, the weapon is to be removed form the possession of the owner.

Features not allowed for NEW guns:
265.00(22) changes the definition of assault weapon to one of what used to be known as "evil features," and expands the list of "evil features."
Evil Features for S/A Rifles:
1) Folding or Telescoping Stock.
2) Pistol Grip.
3) Thumbhole Stock.
4) Second Grip (read: vertical foregrip)
5) Bayonet Mount.
6) Flash Suppressor, Muzzel Break, Compensator or Threaded Barrel.
7) Grenade Launcher.

S/A Shotguns are in a somewhat worse situation if you have a Saiga.
Features limited to one.
Feature list:
1) Folding or Telescoping Stock.
2) Thumbhole Stock.
3) Second Grip.
4) Fixed Magazine 7+ Rounds.
5) Ability to Accept a Detachable Magazine.

400.00(16-a):
Pre-1994 Ban guns and guns that were in compliance with the 2000 New York Ban need to be registered with the State Police within one year of the effective date of the new ban.
Except 50 yr. C&R guns can be registered at any time, but within 30 days of transfer into the state. C&R guns and feeding devices are transferable with proper notifications.


Magazines:
Large Capacity Ammunition Feeding Devices are redefined in 265.00 (23):
A magazine that has a capacity of more than 10 rounds.
A magazine that contains more than 7 rounds. (Meaning that you can use you pre-2013 ban 8-10 rounders but can only out 7 bullets in them).
A magazine obtained after the effective date of the new legislation that can accept more than 7 rounds.
Exemptions: Curio and Relic magazines and tubular .22 attached magazines.
Curio and Relic mags are mags 50 years old or older, only capable of working in a firearm made 50 years ago.
C&R mag possessors must be registered pursuant to 400.00(16)(a).

265.36 - Magazines manufactured before 9/13/94 that can accept or can be readily converted to accept more than 10 rounds:
These magazines are now illegal.
If you have a "reasonable belief that it was lawful to possess" and you surrender or destroy it within 30 days of being told that it is illegal, you are not guilty of the unlawful possession.
Possession is otherwise a Class A Misdemeanor.

265.37 - Magazines 8-10 rounds that are loaded with more than 7 rounds.
Possession in the home is a violation. Second offense is a Class B Misdemeanor.
Possession outside of the home is a Class B Misdemeanor. Second offense is a Class A Misdemeanor.

I was wondering about how this would affect your gun ownership rights. Thanks for posting the details.

Man, those are some seriously draconian restrictions. Come down South for your vacation, eat some seafood, and shoot some guns.

Sorry, cetane -- but at least you still have your beautiful farm and house!

3) Thumbhole Stock. Because you can kill someone with your thumb
4) Second Grip (read: vertical foregrip) Because holding onto a gun TIGHTER... kills people
5) Bayonet Mount. Because you brought a knife to a gunfight
6) Flash Suppressor, Muzzel Break, Compensator or Threaded Barrel. Because "things" that hang off the end of a gun baffle our minds
7) Grenade Launcher. Because everyone has illegal and unobtainable grenades

Its soo far out it has to be able to get overturned in court. I have no problem giving $1000 per month myself to fight this thing. I just hope the NYSRPA and NRA can file suit to put this on hold. :(

Yes, you got it. It has NOTHING to do with reality. I have not even read or tried to understand it yet. It will take awhile before I can do it.

Cetane, you and all NY gun owners got thrown aside so some POS politician can say "Hey I did something."- No matter how wrongheaded and pointless. I wish I could offer more than condolences.

Oh, I go to Georgia to buy a low boy trailer and this is what I come back to. Im gone 3 days and this happens! I have also started to move heavy equipment again, so thats why I have not been around. I do stop at places to get wi-fi to check emails and such. But I am livin in my tractor 3 days at a time. Thanks guys, but this is not over by a long shot. If I cant spend my money on "guns" I will spend it fighting the law.

VT is only 22 miles away. I may have to buy something there. I just have a year before I need to do anything. 05261 is real close to where I am now 12123.

The NY ban, as currently written, neglected to exempt law enforcement from the 7 round magazine maximum.. Despite that they are civilians who should not need 'weapons of war' any more than I do - how long do you think it will it take for an amendment to be filed? It looks like Deval will try to follow suite with 'me too' legislation for MA. I am moving to Maine..

I forsee a rise in C&R applications. Their "magazine" discription for C&R firearms is too vague. Rather curious how newly manufactured enbloc clips would fall into that catagory given they hold 8.

The ease that these stupid rules became law in NY only supports my theory that if the ****e really hits the fan, then it will become a civil war with the states fighting each other. One set on the side of the federal govt. and the others on the side of liberty. Thank god for Texas and the other freedom loving states.
